Custom Design Terms & Conditions

By proceeding with a custom design order, the customer acknowledges and agrees to the following terms and conditions.

1. Custom Design Service

Canvas & Ink provides custom artwork and design services created specifically for the individual customer. Custom designs are developed based on the information, ideas, images, references and instructions supplied by the customer.

The customer is responsible for providing accurate information and suitable reference material where required.

2. Design Deposit & Payment

A deposit or full payment may be required before design work commences, as advised by Canvas & Ink.

Design work will not commence until the required payment has been received.

Any outstanding balance must be paid in full before the completed design is supplied or the associated products are produced.

3. Design Revisions

The customer will be given the opportunity to review the design during the agreed design process.

A reasonable number of revisions may be included in the quoted price, as agreed at the time of the order.

Additional revisions, substantial changes to the original concept, or changes requested after the design has been approved may incur additional charges.

Changes that require the design to be substantially recreated may be treated as a new design request.

4. Customer Approval

The customer is responsible for carefully checking the final design before approving it for production.

Once the customer has approved the final artwork, any subsequent changes may incur additional design and production costs.

Canvas & Ink is not responsible for errors, omissions or changes that were present in the approved artwork.

5. Custom Designs Are For The Individual Customer

All custom designs created by Canvas & Ink are commissioned specifically for the individual customer.

Custom designs are not automatically added to, reproduced as, or featured as part of the Canvas & Ink product range.

A customer's custom design will remain an individual design created for their personal use and will not be reproduced, sold or offered to other customers without the customer's permission.

6. Design Storage & Future Orders

Canvas & Ink will retain a copy of the customer's completed custom design on file.

This allows the customer to request the same design on future Canvas & Ink purchases without having to have the artwork recreated.

Future products featuring the customer's custom design will be subject to the current product pricing and production costs applicable at the time of the new order.

7. Custom Artwork & Copyright

Unless otherwise agreed in writing, the original artwork and design files created by Canvas & Ink remain the intellectual property of Canvas & Ink.

The customer receives permission to use the completed design for their own personal purchases and products ordered through Canvas & Ink.

This does not include permission to reproduce, alter, sell, distribute or commercially exploit the artwork independently unless otherwise agreed in writing.

Where a customer supplies their own photographs, logos, artwork, trademarks or other material, the customer confirms that they have permission to provide and use that material for the purpose of the custom design.

8. Customer-Supplied Images & References

Customers may provide photographs, artwork, vehicle images, logos or other references to assist with the creation of their custom design.

The customer is responsible for ensuring they have the appropriate rights or permission to use any material they provide.

Canvas & Ink will use customer-supplied material solely as a reference for the commissioned design unless otherwise agreed.

9. Canvas & Ink Branding

Custom designs created by Canvas & Ink will include Canvas & Ink branding, identification or credit as part of the custom design service.

The inclusion of Canvas & Ink branding does not make the customer's custom design part of the standard Canvas & Ink product range.

10. Production

Once the final design has been approved, the artwork will be prepared for production on the agreed product or products.

Colours, placement and appearance may vary slightly between digital previews and the final physical product due to differences in screens, printing processes, materials and product surfaces.

11. Cancellation

If a customer cancels a custom design order after design work has commenced, any deposit or design fee may be retained to cover work already completed.

If substantial design work has been completed, the customer may be responsible for any additional design costs incurred up to the date of cancellation.

Custom-made products that have already entered production cannot generally be cancelled or refunded due to their personalised nature.

12. Refunds & Returns

Custom-designed and personalised products cannot be returned or exchanged simply because the customer has changed their mind, selected the wrong size, or no longer requires the product.

Nothing in these terms excludes or limits any rights the customer may have under Australian Consumer Law in relation to faulty, defective or incorrectly supplied goods.

13. Turnaround Times

Custom design turnaround times will vary depending on the complexity of the design, the number of revisions required and current production workload.

Any estimated completion date provided by Canvas & Ink is an estimate only unless a specific deadline has been agreed in writing.

14. Design Approval & Production Delays

Canvas & Ink is not responsible for production delays caused by delayed customer responses, delayed approvals, changes to the design after approval, or failure to provide required information or reference material.

15. Final Artwork Files

Unless specifically agreed otherwise, Canvas & Ink does not provide customers with editable source files, working files or high-resolution production files.

The customer receives the finished custom design for the agreed purpose and products.

16. Portfolio & Promotional Use

Canvas & Ink will not automatically use a customer's custom design as part of its standard product range.

If Canvas & Ink wishes to use a customer's custom design for promotional purposes, portfolio material, social media, advertising or future commercial use, permission will be requested from the customer where required.

Permission to display a design for promotional purposes does not give Canvas & Ink permission to sell the design as part of its standard product range unless separately agreed.

17. Changes to Custom Design Terms

Canvas & Ink reserves the right to update these terms and conditions from time to time.

The terms applicable to an order will be those accepted by the customer at the time the custom design order is placed.

18. Acceptance of Terms

By making payment, approving the commencement of design work, or proceeding with a custom design order, the customer confirms that they have read, understood and agreed to these Custom Design Terms & Conditions.
